1. Scope and Legal Enforceability
These Terms of Service ("Agreement") constitute a binding contract between Gridsbrowselb Oy (Business ID: FI-3289190-4), having its principal place of business at Mannerheimintie 142 B, 00270 Helsinki, Finland, and any corporate entity, housing cooperative (Asunto-osakeyhtiö), property manager (Isännöitsijä), or private consumer engaging our services.
For business-to-business (B2B) building contracts, the General Conditions for Building Contracts (YSE 1998 / RT 16-10660) apply as supplementary terms. For consumer clients, mandatory provisions of the Finnish Consumer Protection Act (Kuluttajansuojalaki 38/1978) prevail.
2. Emergency Dispatch & On-Site Access
Upon submission of an urgent dispatch request or emergency telephone call:
- Dispatch Commitment: Gridsbrowselb deploys the nearest specialized vehicle. Interventions are subject to road traffic conditions and extreme weather hazards.
- Customer Obligations: The customer must ensure unobstructed access to the property water main valve, district heating substation room, basement drains, and electrical supply panels. If access is obstructed or hazardous, stand-by time will be charged at standard hourly rates.
- Right of Refusal: Our technicians reserve the right to suspend work if electrical grounding violates Tukes electrical safety standards, if active asbestos hazards are uncovered, or if structural collapse poses an imminent health hazard.
3. Pricing, Tariff Schedules, & Payment Terms
Services are invoiced based on agreed fixed quotes or hourly rates published on our Service Roster:
- Emergency Call-Out Minimum: Emergency out-of-hours dispatches carry a minimum 2-hour billing charge plus the standard vehicle dispatch surcharge.
- Payment Terms: For commercial accounts, payment terms are strictly 14 days net from invoice date. For consumer clients, payment is due upon issuance of the electronic invoice. Late payments accrue statutory interest in accordance with the Finnish Interest Act (Korkolaki 633/1982).
- Household Tax Deduction: Gridsbrowselb is registered in the Finnish Prepayment Register (Ennakkoperintärekisteri), entitling eligible consumers to claim the Kotitalousvähennys tax deduction on all labor costs.
4. Warranty Terms & Workmanship Guarantees
We stand firmly behind the excellence of our Finnish engineering:
- General Plumbing Repairs & Installations: 24-month comprehensive warranty on workmanship from the date of final commissioning.
- Trenchless Pipe Relining (Sujutus): 20-year structural warranty on cured-in-place epoxy liners when installed under certified Finnish LVI-RYL guidelines.
- Equipment & Parts: Manufacturer warranties apply directly (e.g., Danfoss, NIBE, Jäspi, Grundfos) ranging from 2 to 5 years.
- Exclusions: Warranties do not cover damage caused by unauthorized third-party tampering, freezing resulting from building heating failure below -20°C where adequate heating was not maintained, or foreign objects flushed into drainage systems.
5. Limitation of Liability & Comprehensive Insurance
Gridsbrowselb Oy maintains an active commercial liability insurance policy (Toiminnan vastuuvakuutus) with a maximum coverage of €5,000,000 (Five Million Euros) per incident with a recognized Nordic insurer.
To the maximum extent permitted by applicable Finnish law, Gridsbrowselb Oy shall not be held liable for indirect, incidental, or consequential damages, including loss of rental revenue or temporary relocation expenses, except in cases of proven gross negligence or willful misconduct.
6. Intellectual Property & Diagnostic Data
All condition assessment reports, 4K CCTV video files, CAD hydraulic schematics, and technical writeups generated during diagnostics remain the intellectual property of Gridsbrowselb Oy, licensed to the client for property management, repair authorization, and insurance claim verification purposes.
7. Governing Law and Dispute Resolution
This Agreement shall be construed and governed exclusively by the laws of the Republic of Finland. Any dispute, controversy, or claim arising out of or relating to this contract shall be settled primarily through amicable negotiation. If an agreement cannot be reached:
- For consumer customers: You may refer the matter to the Finnish Consumer Disputes Board (Kuluttajariitalautakunta, www.kuluttajariita.fi).
- For corporate entities: Disputes shall be submitted to the exclusive jurisdiction of the District Court of Helsinki (Helsingin käräjäoikeus).
